NZ's New Worker Protection Act Combatt Migrant Exploitation

The Worker Protection (Migrant and Other Employees) Act 2023 takes effect on January 6, 2024.

The Act introduces comprehensive amendments spanning the Employment Relations Act, Immigration Act, and Companies Act, targeting migrant exploitation.

Immigration Act Amendments: Employers must furnish employment-related documentation within 10 working days upon request by an immigration officer.

Introduction of 3 new immigration infringement offences, including:

  • Allowing unauthorized individuals to work in the employer's service.
  • Employing individuals in violation of work-related conditions on their visa.
  • Failure to comply with the requirement to supply documents within 10 working days.
